§ 4.8.20. Changing nonconforming status to conforming.

  • A.

    A use that is nonconforming because it has not obtained approval through the required approval procedure may become a conforming use by gaining approval through the applicable review procedure.

    B.

    A use that is nonconforming because it is not allowed in a zoning district may seek conforming status through a rezoning of the property (section 4.4) and subsequent approval through the appropriate review procedure or through the special exception process (section 4.7).

    C.

    A building or structure that is nonconforming because it has not obtained approval by the flood review board or because it does not meet current setbacks or height restrictions may become a conforming building by obtaining flood review board approval and/or obtaining the necessary setback or height variance approval as applicable to address the nonconforming element(s) of the building.
