§ 4.7.4. Conditions of approval.

  • A.

    The county commissioners may impose conditions on a special exception use necessary to accomplish the purposes and intent of this code and the master plan; prevent or mitigate adverse effects on the public, neighborhoods, utilities and county facilities; and ensure compatibility of land uses.

    B.

    These conditions may include, but are not limited to:

    1.

    Limitations on the size, bulk and location of buildings;

    2.

    Limitations on the extent and intensity of the proposed use;

    3.

    Standards for landscaping, buffering and lighting;

    4.

    Requirements for adequate ingress and egress;

    5.

    A specific, limited time period to complete the project;

    6.

    Limitation on the duration of the use; and

    7.

    Limitations on the hours of operation.

    C.

    The county commissioners may require, as a condition of approval, that the applicant sign a development agreement (see section 12.6 (post-approval requirements) to ensure completion of any public improvements related to the approved special exception.
